The Trademark and Copyright group provides clients with guidance on a wide range of U.S. and international trademark issues, from trademark clearance and filing to registration and maintenance. For more than 50 years, Sheridan Ross attorneys have assisted clients with the implementation and execution of brand management strategies suitable for each client’s particular business needs.

Sheridan Ross attorneys have prosecuted thousands of U.S. trademark applications in front of the U.S. Patent and Trademark Office. In addition, the firm regularly represents clients before the U.S. Patent and Trademark Office’s Trademark Trial and Appeal Board in ex parte appeals, oppositions and cancellation actions. The group has appeared before the Court of Appeals for the Federal Circuit.

The firm’s lawyers are skilled in providing advice on worldwide filing strategies, including reviewing strategies for filing in the European Community and under the Madrid Protocol. We use a carefully selected network of foreign attorneys to assist clients with their needs outside the United States.

Trademark protection does not end with registration. The firm assists clients with policing their valuable trademarks against unauthorized uses and defending their trademarks from third party claims. Sheridan Ross attorneys work with clients to establish internal procedures to protect their marks and to provide timely responses when outside counsel assistance is needed. In addition, the firm’s lawyers routinely draft and review trademark licensing agreements, including cross-branding agreements and co-branding agreements.

The firm’s attorneys have extensive experience in connection with Internet issues, such as domain name disputes under the Uniform Domain Name Dispute Resolution Policy (UDRP), dealing with cybersquatters, use of trademarks in advertising and unlawful sale of trademarked merchandise on the Internet. The Trademark and Copyright group drafts and edits privacy and terms of use policies, web site development agreements, and other Internet-related agreements.

With regard to copyright law, the firm assists clients with copyright protection, registration, licensing, and the use of works owned by third parties. Copyright services include the registration of copyrights in computer software, as well as drafting and reviewing computer software license agreements. Copyright law advice is provided with respect to all types of copyright works, including literary works, photographs, architectural designs, sculptures and product designs. If a client is interested in using the copyrighted work of another, our firm can counsel on fair use issues and obtaining appropriate permissions.
