Sheridan Ross is proud to host an International Trademark Association meeting on Wednesday, Oct. 25 in its Denver office. The event, which will be held from 12 to 2 p.m., is open to INTA and non-INTA members and will focus on Protection and Enforcement of Well-Known Marks. Discussion topics will include the difference between dilution and likelihood of confusion and the parody defense. Sheridan Ross announced today that it has named four new shareholders in the firm, effective Aug. 18.

The new shareholders are James Burke, Hiwot Covell, Patricia Ho and David Kellis.  Burke and Covell were firm associates while Ho and Kellis served as Of Counsel.

On May 22, 2017, the U.S. Supreme Court put sharp new limits on where patent-infringement lawsuits can be filed, undercutting patent owners’ ability to channel cases to favorable courts.

The court unanimously ruled in favor of TC Heartland LLC, an Indiana-based maker of water flavorings that said a Kraft Heinz Co. unit shouldn’t be allowed to sue it in Delaware. The high court said patent suits should be filed in the state where the defendant is incorporated.

Her practice includes all aspects of domestic and foreign patent preparation and prosecution, reexamination proceedings, patentability and freedom to operate opinions, due diligence reviews and patent litigation support.

Founded in 1981 in response to cuts in federal funding for legal aid, the nonprofit 501(c)(3) tax-exempt organization is governed by a volunteer Board of Trustees composed primarily of lawyers from around the state.

A team of attorneys from Sheridan Ross served as lead counsel for petitioner Terumo BCT, Inc., a global leader in blood component and cellular technologies, to earn a favorable inter partes review (IPR) decision from the Patent Trial and Appeal Board (PTAB).

The June 24, 2016 Final Written Decision of the PTAB found that Terumo “met its burden of showing, by a preponderance of the evidence,” that three claims of Patent 8,777,921 B2, titled “Sterile Sampling Methods and Apparatus,” were unpatentable.

The U.S. Patent and Trademark Office unveiled its Post-Prosecution Pilot (P3) Program on July 11 as a part of its Enhanced Patent Quality Initiative. The P3 Program is designed to give inventors more feedback when their patent application is rejected and reduce the number of appeals to the Patent Trial and Appeal Board.

Bomkamp’s practice focuses on the preparation and prosecution of patent applications in the electrical, mechanical and computer software industries. Daley’s practice is focused on providing Intellectual Property counsel in the technology and software industries.

Although extremely rare, a Western District of Tennessee court ruled last week that “treble damages are appropriate” in the patent infringement case Sheridan Ross filed on behalf of its client WCM Industries and its Watco Manufacturing division. And, in a separate order issued on May 16, the court issued a permanent injunction giving the opposing party until mid-August to remove all infringing products from the marketplace.

Firms were selected from IP Today’s top firms for 2015 and all have at least 250 disposed applications in the tech center. Time to disposition was measured by the average number of months between an application’s filing date and the date it was either patented or abandoned.

A team of Sheridan Ross volunteers spent a recent Saturday morning volunteering at Food Bank of the Rockies (FBR) where they helped package food items for distribution to some of the more than 800 food resource organizations across the region supported by FBR. Team Sheridan Ross helped package more than 750 boxes of nutritional food items totaling nearly 22,000 pounds in just three hours.

It has been more than a year since the Supreme Court rendered its decision in Alice Corp. v. CLS Bank International.  Since that decision, the USPTO has struggled with the implementation of the decision and, as a result, many examiners have been afraid or unwilling to allow certain types of patent applications – especially those examiners assigned to the business methods art unit.
 
On July 30, the USPTO issued new interim guidance on subject matter eligibility.  A link to these guidelines is provided below.

DENVER — On March 24, ten Sheridan Ross patent attorneys and patent agents presented a day of programming at the American Chemical Society's annual conference in Denver. The event, which drew nearly 14,000 chemists, academics, attorneys and other professionals to the city, was the organization's 249th conference, and it provided multiple tracks of programming including one that was exclusively focused on chemistry and the law.

DENVER – Ten attorneys from Denver-based Sheridan Ross P.C. were selected for inclusion to Super Lawyers 2015 and another seven attorneys were named Rising Stars.

In addition, Shareholder John Posthumus was also honored with inclusion in the 2015 list of Top 100 Colorado Super Lawyers based on point totals in the nomination, research and the panel’s review process.

Bradley Knepper and Benjamin Lieb’s fifth article in a series of six for InsideCounsel ran February 20, 2015. The article “Tips for patent prosecution strategies post-Alice” focuses on patent prosecution strategies for responding to subject matter rejections in patent applications involving computer implemented inventions.

The article addresses rejections under 35 USC § 101 and the affect is has had on applications assigned to the Patent Office’s group art unit 3600, which examines business method patents, as well as the grounds for such rejections.

Sheridan Ross Co-President Gary Connell was quoted in a Feb. 16 article in BioWorld Today regarding a recent U.S. Patent and Trademark Office case for Johnson & Johnson, which received a final rejection on its patent related to Remicade, a drug used to treat Crohn's disease, colitis and other autoimmune disorders. The ruling provided some indication that patent law related to novel biologics is rapidly changing and the makers of biosimilar or generic drugs may benefit.

Bradley Knepper and Benjamin Lieb’s fourth article in a series of six for InsideCounsel ran February 6, 2015. The article, “The Practical Applications of the New Patent-Eligibility Test,” discusses the birth of a new two-part test for evaluating patent-eligibility as a result of the Supreme Court’s decision in Mayo Collaborative Services v. Prometheus Labs. Inc. and Alice Corp. v. CLS Bank Int’l.

In the article, the authors explain the two-part test and highlight some issues in how it has been applied in recent decisions.

Bradley Knepper and Benjamin Lieb co-authored an article — the third in a series of six — that ran January 23, 2015 in InsideCounsel describing suggested approaches to drafting patent applications directed to computer implemented inventions post-Alice.  The article addresses how one can describe and claim inventions to potentially avoid or overcome challenges on the grounds of subject matter eligibility prior to submission to the U.S. Patent and Trademark Office (USPTO).

Rob Brunelli was quoted in a story that ran in the February/March issue of Pharmafocus about the U.S. Supreme Court’s ruling in Teva Pharmaceuticals USA, Inc. v. Sandoz, Inc.

The Court ruled in favor of pharmaceutical company Teva allowing it to continue marketing its multiple sclerosis drug Copaxone without the threat of being undercut by cheaper generic versions of its top-selling MS drug.

DENVER – Sheridan Ross P.C. announced today that Pamela N. Hirschman, Sarah J. Schneider and Tadd F. Wilson have been named firm Shareholders.  Hirschman and Schneider are both members of the firm’s Trademark and Copyright Practice Group while Wilson is a part of the Patent Prosecution Practice Group.

Hirschman has experience in all areas of trademark law, and is a former Trademark Examining Attorney with the U.S. Patent and Trademark Office.

Miriam Trudell wrote an article for the International Trademark Association’s INTA Bulletin, which explores the question who qualifies for Madrid Protocol filings. The article outlines the multiple factors that influence the decision whether to file a national or a Madrid Protocol application, including some unique requirements of U.S. trademark law.

John Posthumus was quoted in a July 2, 2014 InsideCounsel article about the opening of a new USPTO in Denver.  Colorado leaders expect Denver's satellite office to bring hundreds of jobs and economic activity worth about $440 million over its first five years of operation. In addition to hiring up to 120 patent examiners in metro Denver, the USPTO office will draw inventors, venture capitalists, entrepreneurs and IP attorneys to the region, and will further breed and expand Colorado's already strong high-tech and innovation economy.

John Posthumus was quoted in a June 30, 2014 Managing IP article about the opening of a satellite USPTO in Denver and the effort it took to open a USPTO in the region. Denver, the first of three new USPTO satellite offices to open, following the opening of Detroit’s satellite office in 2012, is expected to help improve the quality and transparency of the USPTO while helping reduce pending patent applications on a national scale.

The opening of the Rocky Mountain Regional Satellite office in Denver on June 30 marks an unprecedented and historic moment for the U.S. Patent and Trademark Office. Never in its history has the USPTO had a base of operations that extended beyond the Eastern Time zone. The USPTO has operated exclusively for more than 200 years in the Washington, D.C. area until July 2012, when the USPTO opened its first satellite office in Detroit.

John Posthumus was quoted June 30, 2014 in Patent, Trademark & Copyright Journal on the opening of a satellite USPTO in Denver.  In 2000, Posthumus, with IP boutique firm Sheridan Ross P.C., Denver, saw an increase in patent applications originating in Colorado. He approached Sen. Michael Bennet (D-Colo.), to urge that Denver be designated as a satellite site.

Posthumus said that he saw the opening as “a game-changing moment” for the Denver region.

June 30, 2014 — COLORADO PUBLIC RADIO – The U.S. Patent office opens its newest branch in Denver on Monday. It’s one of four satellite branches the Patent Office has decided to open. The others will be in Detroit, Dallas and San Jose’s Silicon Valley.

Patent Attorney John Posthumus, with the law firm Sheridan Ross, lobbied to get the branch in Denver.

He says the city’s central location, its international airport and high-tech sectors were leading factors in Denver’s selection.

Sheridan Ross partners Robert Brunelli and Benjamin Lieb were quoted in a Law360 roundup published on June 2, 2014 on the significance of two United States Supreme Court rulings in Nautilus Inc. v. Biosig Instruments Inc. and Limelight Networks Inc. v. Akamai Technologies Inc. matters.

In Nautilus, the U.S. Supreme Court ruled that the Federal Circuit’s long-standing precedent for proving a patent indefinite allowed for too much ambiguity.

Robert Brunelli was quoted in a CNET article on May 11, 2014 about a patent Amazon won this year that covers a technique for taking photos with a no-fuss background. According to the article, Amazon’s patent raises questions the merits of the US patent system.

Robert Brunelli contributed to an article on Law360 that provided reaction to the Supreme Court’s decisions in Highmark Inc. v. Allcare Health Management Systems Inc and Octane Fitness LLC v. Icon Health & Fitness Inc., that make it easier for courts to sanction plaintiffs that bring meritless patent infringement lawsuits.

According to Brunelli, the opinions change the law significantly.

Genetic Technologies Limited (“GTG”) has defeated a motion to dismiss brought by Agilent Technologies, Inc. in the United States District Court for the Northern District of California.  Benjamin Lieb of Sheridan Ross PC argued the motion to dismiss on behalf of GTG.

GTG’s Complaint alleged that Agilent infringed U.S. Patent No. 5,612,179 (“the ‘179 Patent) through its sale of products used for DNA testing and analysis. Agilent moved to dismiss the Complaint, arguing that the ‘179 Patent did not claim patent eligible subject matter pursuant to 35 U.S.C. § 101.
